Terms and conditions overview
Margaret River Exposed tours provides in general, tours that are nature based. Encompassing but not
limited to experiencing scenic vista trails, wildflower photography, bush walking and extended road trips with overnight stays in accommodation as agreed with the customer within Western Australia.
All tour itineraries as described within this website however, will remain flexible and at the discretion of Margaret River Exposed may be altered to accommodate changes in the weather, safety of the
customer and in the main designed to deliver to you the customer an enjoyable experience.
This statement of intent is made in good faith and transparency and should be read in conjunction
with the Terms and conditions and Indemnity.
Acceptance to Terms and Conditions Margaret River Exposed tours.
Upon payment and securing a tour booking with Margaret River Exposed tours you the customer
acknowledge and accept the Terms and Conditions and Indemnity herein.
Cancellation Policy
• Margaret River Exposed offers a 100% refund Policy for the duration of the Corona Virus
(COVID 19 ) pandemic.
• Non COVID related cancellation Margaret River Exposed offers a 100% refund up to 4 days prior to tour date then a 30% cancellation charge will be deducted from refund.
Tour Departure.
• Margaret River Exposed tours departs from the Margaret River Visitors centre located on the corner of Tunbridge street and Bussell Highway in the township.
• Tours depart @9.00am unless an alternate time is arranged prior with the tour operator.
• Complimentary pick up service is included within a 10Km radius of the immediate township.
• Alternate pick up locations can be arranged which may incur an additional fee and will be advised as part of the booking process.
Privacy Policy
• Gathered information from you the customer is used for the express purpose of enabling you to understand the services, tour products and to book tours with Margaret River Exposed and for you
the customer to be aware that Margaret River Exposed is providing its services in good faith and transparency.
• Margaret River Exposed undertakes to its best ability to safeguard any information you the customer provides and shares according to strict standards of security and confidentiality.
• Your information may be kept indefinitely.
• Your information is never sold for commercial gain.
• Margaret River Exposed uses and engages the services of third party booking services who will gather information from you the customer to complete a tour booking transaction.
• Your information is never provided to an advertiser and in the event of doing so will only be supplied with your expressed written permission.
• Photographs taken by you or by Margaret River Exposed or shared by you with Margaret River Exposed on tour may be used for display purposes on the website of Margaret River Exposed and its social media links to its website.
• Margaret River Exposed will use your address, email address and/or telephone number to contact you when you submit a question, suggestion or comment.
• Any links to other websites provided by Margaret River Exposed for the convenience of our customers does not imply an endorsement of the views, information or products provided by such websites. If you submit personal information to or via any linked site, the privacy principles applying to that information will be outside the control of Margaret River Exposed.

ACCIDENT WAIVER AND RELEASE OF LIABILITY
I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH THIS TOUR, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.
I certify that I am physically fit, have sufficiently prepared or trained for participation in this activity, and have not been advised to not participate by a qualified medical professional.
I certify that there are no health-related reasons or problems which preclude my participation in any of the tours offered by
Margaret River Exposed.
I acknowledge that this Accident Waiver and Release of Liability Form will be used by the organiser of the activity in which I
may participate, and that it will govern my actions and responsibilities at said activity.
In consideration of my application and permitting me to participate in this activity, I hereby take action for myself, my
executors, administrators, heirs, next of kin, successors, and assigns as follows:
• (A)I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this activity, THE FOLLOWING ENTITIES OR PERSONS: Margaret River Exposed
• (B)INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise.
• I acknowledge and unconditionally release and forever discharge any persons, entities, and their respective directors, officers, employees, agents, contractors, partners, shareholders, successors, assignees, parent or subsidiary entities, representatives, are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf.
• I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity.
The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
BY BOOKING AND SECURING ANY OF THE SAID TOURS AS DESCRIBED HERIN ON THE WEB SITE OF MARGARET RIVER EXPOSED YOU ACKNOWLEDGE AND CERTIFY THAT YOU AND ANY THIRD PARTY
PARTICIPANT’S ON TOUR HAVE READ THIS DOCUMENT AND FULLY UNDERSTAND ITS CONTENT.
YOU AND ANY THIRD PARTY ARE AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT TO ALL TOURS PROVIDED BY MARGARET RIVER EXPOSED IS OF YOUR OWN FREE WILL.
